The Classroom Exception

Teachers have the right to display and perform copyrighted works in the classroom if the following conditions are met:

  • It must be face-to-face instruction
  • It must be a non-profit educational institution
  • It must be a legal copy of the material
  • It must be in a classroom or similar place devoted to instruction

The TEACH Act

The TEACH Act allows for the use of copyrighted works for distance or online education in limited circumstances and under certain conditions.

  • The institution must be an accredited, non-profit educational institution.
  • The use must be part of mediated instructional activities.
  • The use must be limited to a specific number of students enrolled in a specific class.
  • The use must either be for live or asynchronous class sessions.
